Tracy
Armstrong is a member of the employment law and corporate
litigation departments. She has expertise in representing
management in employer/employee disputes and the laws
governing the employer/employee relationship. She offers
highly skilled representation in claims and matters
involving employment law including, but not limited
to, the New Jersey Law Against Discrimination (LAD),
harassment and hostile work environment, as well as
the Conscientious Employee Protection Act (CEPA), the
Family Medical Leave Act (FMLA), the Americans with
Disabilities Act (ADA) and the Age Discrimination in
Employment Act (ADEA).
In addition to the defense of litigated
claims, Ms. Armstrong provides advice and counsel in
drafting and reviewing employee handbooks/corporate
policy manuals, including anti-harassment and EEO policies,
employee contracts, non-compete agreements/restrictive
covenants and confidentiality agreements. Ms. Armstrong
also conducts regularly scheduled training seminars
on a variety of issues including, but not limited to,
harassment, interviewing and termination procedures.
These services are designed to assist the employer’s
business operations and to avoid litigation. She also
appears before the Wage and Hour Board and Department
of Unemployment. Ms. Armstrong also regularly provides
counsel to clients in the sensitive and critical areas
of severance and termination. Ms. Armstrong has extensive
experience in all phases of employment and commercial
litigation including pre-trial discovery, motions, depositions,
mediation, arbitrations and trials.
Ms.
Armstrong is a member of the Monmouth Bar Association
(Labor and Employment Committee) and New Jersey State
Bar Association (Labor and Employment Section, Executive
Committee). She has served as a member of the Board
of Directors for the Monmouth University Alumni Association.
