Freehold New Jersey Uber Accident Attorneys
Uber, Lyft, and other rideshare services have become increasingly popular among city dwellers who don’t want to deal with the hassle of finding and paying for parking, college students who do not own a car, and everyone else in between. While grabbing an Uber or Lyft car is certainly easy and convenient, if your rideshare driver gets into an accident and you are injured, things can quickly become complicated. Accident attorneys at Lomurro Munson LLC are experienced in handling car Uber, Lyft, and other rideshare accident claims, successfully recovering just compensation for accident victims.
New Jersey’s Regulation Of Ridesharing Businesses
In 2017, New Jersey Governor Chris Christie signed the Transportation Network Company Safety and Regulatory Act, which regulates ridesharing businesses. Under this legislation, rideshare drivers and their employers are required to meet certain insurance coverage standards in addition to submitting to driving and criminal background checks. Drivers must be a minimum of 21 years old, and provide evidence of their drivers’ license, car registration, and insurance. The ride sharing companies must maintain driving history records of each driver for a period of five years. Drivers that have been convicted of any of the following offenses are banned from employment by the ride sharing company:
- Homicide
- Sexual assault
- Driving under the influence of alcohol or drugs (DUI)
- Possession or sale of a controlled dangerous substance
- Reckless driving
Who Covers My Medical Expenses If I Am Injured In A Rideshare Accident?
In New Jersey, rideshare passengers who are injured in an accident while being transported by a rideshare company will receive medical coverage through the rideshare company, the driver, or both. The insurance provides for $1.5 million in medical expenses stemming from the accident.
Filing A Personal Injury Claim For A Rideshare Accident
Personal injury law protects those who have suffered injury or death due to another person or entity’s negligent behavior. However, filing a personal injury claim for a rideshare accident is complicated. Many rideshare drivers are independent contractors and the rideshare company’s insurance policy may not cover the accident. If a rideshare driver is involved in an accident while they are not providing fares – or are in between fares – the claims process can become even more complex.
