New Jersey law provides for a variety of possible penalties for a DUI conviction. The penalties you may face are directly linked to your blood alcohol concentration (BAC) at the time of your arrest and your prior history, if any, of DUI convictions. The penalties for DUI for a:

  • First offense with a BAC of .08 – .10% – fines of up to $400, jail sentence of 30 days or less, three-month driver’s license suspension and potential community service or rehabilitation program
  • First offense with a BAC greater than .10% – fines up to $500, imprisonment for up to 30 days, driver’s license suspension for at least seven months and potential community service or rehab program
  • Second offense – up to $1000 in fines, at least 48 hours in jail and up to 90 days, mandatory driver’s license suspension for two years and 30 days community service
  • Third and subsequent offenses – at least $1000 in fines, mandatory minimum of 180 days in jail, driver’s license suspension for 10 years and community service

What Is An Ignition Interlock Device?

Another potential penalty for a DUI conviction is an ignition interlock device (IID). An IID prevents a driver from starting their vehicle before breathing into a breathalyzer unit that measures BAC. The court has the discretion to order an IID installed for any DUI conviction. An IDD is mandatory for second and subsequent convictions and convictions involving a BAC of .15% or higher.
